Terms of service

These terms tell you who we are, how we will provide products to you, and other important information. Please read them before you order. The Fat Butcher is a trading name of Food Direction Ltd, a company registered in England and Wales under company number 13822023, with its registered office at Double Row, Seaton Delaval, Northumberland, NE25 0PP.

These terms and your legal rights

We are a supplier of food to consumers for private, domestic use. Nothing in these terms affects your legal rights as a consumer. Where anything in these terms conflicts with your statutory rights, your statutory rights prevail.

Placing an order

When you place an order you are offering to buy from us. Your order is accepted, and a contract is formed, when we send you confirmation. If we cannot accept your order (for example because a product is unavailable, a pricing error has occurred, or we cannot deliver to your address) we will let you know and will not charge you, or will refund you in full.

Prices and payment

Prices are shown on the website and may change from time to time, but changes will not affect orders we have already accepted. Prices include VAT where applicable. Payment is taken at checkout. We reserve the right to correct any obvious pricing errors.

Delivery

Delivery is covered in full by our Shipping & Delivery Policy, which forms part of these terms. In particular, please note the property types we cannot deliver to as standard, and the point at which responsibility for your order passes to you, both of which are set out in that policy.

Cancellations and refunds

Because we sell perishable food, orders cannot be cancelled on or after the day of despatch, and perishable goods are exempt from the standard 14-day cancellation right. Full details, including what to do if your order arrives damaged or spoiled, are in our Refund & Returns Policy, which forms part of these terms.

Food safety, allergens, storage and cooking

Our products are fresh, raw meat and must be handled, stored and cooked correctly. It is your responsibility to make sure our products are suitable for you and anyone you serve them to.

  • Storage: refrigerate or freeze your products promptly on arrival, and use or freeze them by the use-by dates provided.
  • Cooking: cook all raw meat and poultry thoroughly. Poultry, pork, burgers, sausages and rolled or stuffed joints should be cooked all the way through until piping hot; whole cuts of beef and lamb may be cooked to your preference.
  • Allergens: if you have a food allergy or intolerance, please refer to the allergen information on our website and on the product packaging, and contact us before ordering if you are unsure. It is your responsibility to check that a product is suitable for you and anyone you serve it to before it is consumed.

Our liability to you

Nothing in these terms excludes or limits our liability where it would be unlawful to do so. This includes our liability for death or personal injury caused by our negligence; for fraud or fraudulent misrepresentation; for breach of your legal rights in relation to the products (including the right to receive products that are as described, of satisfactory quality and fit for purpose); and for defective products under the Consumer Protection Act 1987.

Subject to the above, we are not responsible for losses that were not foreseeable, for losses caused by events outside our reasonable control, or for business losses, as we supply products to you for private and domestic use only.

Events outside our control

We are not liable for delays or failures in delivery caused by events outside our reasonable control, such as extreme weather, courier disruption, or supply shortages. If such an event affects your order we will contact you as soon as possible and, where appropriate, arrange a new delivery date or a refund.

Governing law

These terms are governed by the law of England and Wales, and you can bring legal proceedings in the courts of England and Wales. If you live in Scotland you may also bring proceedings in the Scottish courts, and if you live in Northern Ireland you may also bring proceedings in the Northern Irish courts.
